By creating an account or using Memtastic, you agree to these terms and to our Privacy Policy (including Smart Notifications where you opt in). If you do not agree, do not use the service.
Memtastic (a brand of 1016 Investments LLC) provides an online application for saving, organizing, and engaging with personal memories and related content. Features may include chat, media, family sharing, notifications, and other tools we add or change over time. We do not guarantee uninterrupted or error-free operation.
You must provide accurate registration information and meet any minimum age or eligibility requirements we specify (including those required by law). You are responsible for safeguarding your account and for activity under your credentials.
You will use Memtastic only in compliance with applicable law and these terms. You will not misuse the service, attempt to disrupt or access it improperly, or use it to harm others or infringe their rights.
You retain ownership of content you submit, subject to the rights you grant us as described in our policies and product flows—broadly, to operate, host, process, and display your content as needed to provide the service and as you choose to share it.
The service relies on infrastructure and vendors (e.g. hosting, authentication, messaging, analytics). Their terms and practices may also apply where relevant.
The service is provided on an "as available" basis. To the fullest extent permitted by law, we disclaim warranties not expressly stated here.
To the fullest extent permitted by law, 1016 Investments LLC and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits or data, arising from your use of Memtastic. Aggregate liability for direct damages may be limited as permitted by law and as we may set forth in a future full agreement.
We may modify these terms or the service; material changes may be communicated in-app or by other reasonable means. We may suspend or terminate access for violations or operational reasons. You may stop using the service at any time.
These terms are governed by applicable law as determined in a definitive legal version of this agreement; until then, disputes should be approached in good faith and resolved under the jurisdiction counsel assigns for the final Terms of Service.
